ESL Gaming Online, Inc. and its subsidiaries (collectively, "EGO" or “Badlion” or "we" or "our") respect your privacy. This privacy policy (this "Policy") informs you of our privacy practices and the choices you can make about the way your information is collected online and how that information is used. If you have any questions, comments or complaints regarding our use of your personal data, please feel free to contact us over the channels provided below.

This Policy applies to all websites, servers and services owned or provided by EGO (collectively, "EGO Sites"). As explained below, this Policy applies only to websites owned and services maintained by EGO and not to websites or services to which links may be provided on EGO Sites. If you are in the European Union and are offered our services, the regulations of the General Data Protection Regulation (“GDPR”) of the European Union apply.

When we refer to “you” in this Privacy Policy, we refer to you as data subject.

II. GDPR - Terms

The meaning of certain terms we use in this Privacy Policy is defined by the General Data Protection Regulation (“GDPR”) of the European Union. All definitions set out in Art. 4 GDPR shall apply to this Privacy Policy. We’d like to explicitly mention the meanings of the following terms to make transparent what the often-used terms personal data, data subject, processing, controller and processor mean according to the GDPR:

  • 'personal data' means any information relating to an identified or identifiable natural person (‘data subject’); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person;

  • processing’ means any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction;

  • controller’ means the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data; where the purposes and means of such processing are determined by Union or Member State law, the controller or the specific criteria for its nomination may be provided for by Union or Member State law;

  • processor’ means a natural or legal person, public authority, agency or other body which processes personal data on behalf of the controller.

III. GDPR - Legal Basis

As a controller we need a legal basis to process your data lawfully, according to Art. 6 para. 1 GDPR. If:

  • you have given your consent to the processing of your personal data for one or more specific purposes, this forms a legal basis according to Art. 6 para. 1 let. a) GDPR;

  • you have given explicit consent to the processing of special categories of personal data (e.g. data concerning health) for one or more specified purposes, and such consent is possible according to applicable law, this forms a legal basis according to Art. 9 para. 2 let. a) GDPR;

  • the processing is necessary for the performance of a contract between you and us or in order to take steps at your request prior to entering into a contract, the legal basis for this is Art. 6 para. 1 let. b) GDPR;

  • the processing is necessary for compliance with a legal obligation to which we are subject, the legal basis for this is Art. 6 para. 1 let. c) GDPR;

  • the processing is necessary to protect our legitimate interests or legitimate interests of a third party and such legitimate interests are not outweighed by your interests or fundamental rights and freedoms, the legal basis for this is Art. 6 para. 1 let. f) GDPR.

IV. GDPR - Your Rights

Under the GDPR you have certain rights concerning the processing of personal data by us. According to the GDPR you have the following rights:

  • Right of information: You have the right to be provided information regarding the processing of your personal data by us, in accordance with Art. 13 and 14 GDPR.

  • Right of access: You have the right to obtain confirmation as to whether or not we are processing your personal data and, if this should be the case, access to the personal data, in accordance with Art. 15 GDPR.

  • Right to rectification: You have the right to obtain rectification of inaccurate or incomplete personal data concerning you, in accordance with Art. 16 GDPR.

  • Right to erasure (“right to be forgotten”): Under certain circumstances you have the right to obtain the erasure of personal data concerning you, in accordance with Art. 17 GDPR.

  • Right to restriction: Under certain circumstances you have the right to obtain the restriction of processing, in accordance with Art. 18 GDPR.

  • Right to data portability: Under certain circumstances you have the right to receive the personal data concerning you, which you have provided to us, in a structured, commonly used and machine-readable format and the right to transmit this data to another controller, in accordance with Art. 20 GDPR.

  • Right to object: Under certain circumstances you have the right to object to the processing of personal data concerning you, in accordance with Art. 21 GDPR. This includes but is not limited to the right to object in cases in which we process your personal data on the legal basis of Art. 6 para. 1 let. f) GDPR.

  • Right to lodge a complaint: You have the right to lodge a complaint with a supervisory authority, in particular in the Member State of the EU of your habitual residence, place of work or place of the alleged infringement if you consider that the processing of personal data relating to you infringes the GDPR.

  • Right to withdraw consent: If a processing of your personal data is based on your consent as set out in Art. 6 para. 1 let. a) GDPR or Art. 9 para. 2 let. a) GDPR, you have the right to withdraw your consent at any time, in accordance with Art. 7 para. 3 GDPR. Such withdrawal does not affect the lawfulness of processing based on consent before its withdrawal.

  • Right to not be subject to a decision based solely on automated processing: You have the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or similarly significantly affects you, as set out in Art. 22 para 1 GDPR.

V. Categories of Recipients

The personal data we process can also be either processed by other parties on our behalf (data processors) or transferred to and processed by other controllers. When data is processed according to this Privacy Policy, in principal, it is done so by the respective internal employees and freelancers of ours that are responsible for pursuing our purposes for the processing.

Recipients of your personal data can belong to the following categories:

  • Social media services (e.g. our Facebook page that you can visit)
  • Payment processors (e.g. so you can pay for our services)
  • Internet Service Providers (e.g. Cloudflare, Google, Amazon)
  • Hosting and content delivery services (e.g. to deliver our websites to you)
  • Cyber security and business intelligence services (e.g. to secure our applications, platforms, networks, and EGO Sites)
  • Other entities of ESL (e.g. when we cooperate to conduct an esports tournament)

EGO will not sell, rent or lease the personal information you provide. EGO will share your personal data as required by a duly authorized request from a government authority, to comply with any law, regulation, warrant, subpoena or order from a court or governmental authority, and to help prevent or investigate suspected fraud, harassment or violation of any law, rule, regulation, EGO policy or EGO terms and conditions. Such transfer of personal data is based on our legal obligation to comply with applicable laws (legal basis: Art. 6 para. 1 let. c) GDPR).

VI. Data Processing

1. Communication via Email and Phone

a. Process

If we communicate with you via email or telephone, we process all personal data you disclose to us during our conversation (e.g. your name, email address, the reason why you are contacting us etc.). If the processing of the data is based on contractual purposes, we require it to be able to conclude or perform a contract with you, which is not possible without this information.

b. Recipients

Recipients of the processed personal data are the respective internal employees and freelancers of ours that are responsible for pursuing our purposes for the processing. The following categories of recipients can receive data:

  • Hosting providers (e.g. Google LLC, Amazon Web Services, Inc., etc)
  • Cyber security providers (e.g. Cloudflare, Inc., Intuition Machines, Inc., etc)
  • Business intelligence services (e.g. Mixpanel, Inc., etc)
  • Customer support services (e.g. Zendesk, Inc., etc)

c. Purpose

Depending on the specific conversation with you, the personal data can either be processed in order to take steps at your request prior to entering into a contract with us or to perform a contract you have concluded with us. Also, the processing can be necessary for the purposes of our legitimate interest to respond to mails and calls of yours when you contact us and to have proof regarding substantial content of our conversation, including but not limited to cases of potential legal claims on our or your side.

d. Legal Basis

The legal basis for processing the personal data in order to take steps at your request prior to entering into a contract with us or to perform a contract you have concluded with us is Art. 6 para. 1 let. b) GDPR. The legal basis for processing the data due to our legitimate interest is Art. 6 para. 1 let. f) GDPR.

e. Storage Period

The data is stored at least for the time until our contract with you is fully performed. If the data has been stored in order to take steps at your request prior to entering into a contract with us, we will store the data for as long as reasons objectively exist to believe that the respective conversation will be continued within the foreseeable future. Apart from this, the data is stored for as long as our legitimate interest exists, which depends on the specific circumstances of our conversation (e.g. the importance of the topic of our conversation to us).

If the data is also processed for another purpose set out in this Privacy Policy, the storage period regarding that purpose applies as well.

2. Badlion.net Website

a. Process

When you visit our website, we process the following data to deliver the website to your browser:

  • IP address and network information
  • Browser details and capabilities
  • Time stamped activity while on our EGO Sites

Note for international users: If you are visiting EGO Sites from a location outside the United States, your connection will be through servers located in the United States and all information you provide will be processed and maintained in our web servers and internal systems located within the United States.

Recipients of the processed personal data are the respective internal employees and freelancers of ours that are responsible for pursuing our purposes for the processing, as well as the following categories of recipients:

  • Customer support services
  • Hosting providers
  • Cyber security services
  • Business intelligence providers

c. Purpose

In order to provide a functioning and consistent service to our customers, our EGO Sites must operate in a secure and robust environment. This requires processing the mentioned data to deliver the websites to your browser. We have a legitimate interest in being able to deliver the EGO Sites to anyone who would like to access it.

d. Legal Basis

The legal basis for the processing of your data based on our legitimate interest is Art. 6 para. 1 let. f) GDPR.

e. Storage Period

The data is stored for 3 years to deliver the EGO Sites and services, and to ensure its functionality and security. If the data is also processed for another purpose set out in this Privacy Policy, the storage period regarding that purpose applies as well.

3. Creation of Membership Accounts

a. Process

When you create an account with us, we process the following information:

  • Email account
  • Password
  • Game account identifier
  • Date of birth
  • Parental guardian email (if parental consent required under law)

b. Recipients

Recipients of the processed personal data are the respective internal employees and freelancers of ours that are responsible for pursuing our purposes for the processing

c. Purpose

The data is required to complete the account registration, so to be able to conclude and perform a contract with you, as well as validate age of consent and obtain permission from guardian if under the age of consent. Validating your age and, if necessary, obtaining consent from your legal guardian is done to comply with any youth protection or similar legal obligation of ours and is also in our legitimate interest to ensure that our users are old enough to use our services. Your game account identifier can be required for the technical functionality of our services that you can use with your account (e.g. Badlion Client, Store, EGO Sites) which we offer you as performance of our contract with you.

d. Legal Basis

The legal basis for processing data for concluding and performing a contract with you is Art. 6 para. 1 let. b) GDPR. The legal basis for processing the data to comply with legal obligations is Art. 6 para. 1 let. c) GDPR. The legal basis for processing the data based on our legitimate interest is Art. 6 para. 1 let. f) GDPR.

e. Storage Period

The data is stored at least for the time until our contract with you is fully performed, so until you close and delete your account. The storage period can also be determined by the necessity of the establishment, exercise or defense of legal claims (Art. 17 para. 3 let. e) GDPR) and in such case the storage period will be as long as the respective statute of limitations.

Data needed to validate your age is stored according to the respective legal provisions which we need to comply with.

If you have been using the Badlion Client and have verifiably cheated, we will store the respective personal data of yours pursuant to Sect. 5.

If the data is also processed for another purpose set out in this Privacy Policy, the storage period regarding that purpose applies as well.

4. Newsletter

a. Process

You can request the receipt of our email newsletter which includes information about products, services, special offers or invitations to participate in various programs. To send you the newsletter we process your email address.

Recipients of the processed personal data are the respective internal employees and freelancers of ours that are responsible for pursuing our purposes for the processing. The following processors process the personal data on our behalf: Amazon Web Services, Inc., Cloudflare, Inc., and Google LLC

c. Purpose

The purpose of processing the personal data is to keep you updated on our products, services, special offers or invitations to participate in various programs via email, according to your opt in to the newsletter receipt.

d. Legal Basis

The legal basis for processing your personal data for the receipt of our newsletter is your declaration of consent, in accordance with Art. 6 para. 1 let. a) GDPR.

e. Storage Period

The data is stored as long as you have not withdrawn your consent. You can at any time withdraw your consent as follows: (i) select the email "opt out" or "unsubscribe" link, (ii) follow the opt-out instructions included in each communication or (iii) write to EGO at [email protected] Please note that the withdrawal does not affect the lawfulness of the processing done prior to your withdrawal. If the data is also processed for another purpose set out in this Privacy Policy, the storage period regarding that purpose applies as well.

5. Badlion Client / Anti-Cheat functionality

a. Process

The Badlion Client contains an anti-cheat software we offer to you. When you install and use the Badlion Client, certain information regarding your computer and software it contains is required for effective operation of the anti-cheat services of the Badlion Client. Information analyzed and/or collected by the Badlion Client includes computer hardware data (e.g. component manufacture details, etc), computer software data (e.g. the version of your operating system, etc), network data (e.g. your IP-address, etc) and in-game snapshots of the game environment.

This information is only collected and transmitted to EGO when you are logged in to the Badlion Client.

b. Recipients

Recipients of the processed personal data are the respective internal employees and contractors of ours that are responsible for pursuing our purposes for the processing. The following categories of third parties can receive data:

  • Hosting providers
  • Analytics and business intelligence services
  • Cyber security services

c. Purpose

By processing the data, we can identify and prevent the use of cheat software, files used to gain an unfair advantage, and - if necessary - enforce bans against players that cheat. Thus, it allows us to retain the integrity of our platform and also ensure cyber security of the servers used by the Badlion Client user. Without processing data, we cannot provide anti-cheat software with the same effectiveness. We also have a legitimate interest in the processing to ensure fair and secure competitions. If competitions lack fairness and security, competitive games will lose players as well as audiences, which would not only be a cultural loss but also detrimental to us as a company.

Also, the data is processed to perform the contract you conclude with us when agreeing to the terms and conditions of the use of the Badlion Client. The data is processed to grant the functionality of the client as an effectively working anti-cheat software that you require to be allowed to join the competitive game of your choice.

d. Legal Basis

The legal basis for processing the data for the performance of our contract with you is Art. 6 para. 1 let. b) GDPR. The legal basis for the processing of the data based on our legitimate interests as stated above is Art. 6 para. 1 let. f) GDPR.

e. Storage Period

The data is stored for the term of the contract between you and us and, if it should outlast such term, for as long as our legitimate interests are given. Personal data that is processed based on our legitimate interest, will be stored as long as it is covered by such legitimate interest. The storage period in such cases is determined by the necessity of the establishment, exercise or defense of legal claims (Art. 17 para. 3 let. e) GDPR) of ours or third parties involved in the competitive game you are playing.

In the light of this, we delete all of your data collected by the Badlion Client after 3 years when you delete your Badlion account, provided you have not verifiably cheated during the use of the software. This storage period is established so we can react appropriately to cheating that we discover after you have deleted your Badlion account by a user and ensure that such user does not keep cheating, e.g. by creating a new user account.

Should you have verifiably cheated during the use of the software, we will store the data for a period according to the period you have been banned for.

Should any legal claims based on cheating or a ban be subject to a respective legal case, the data will be stored until the legal case has been resolved. Due to this, the storage period can be longer as the one’s set out here.

If the data is also processed for another purpose set out in this Privacy Policy, the storage period regarding that purpose applies as well.

6. Commingled Information

a. Process

EGO may cross-check personal data you provide with other personal data of yours which it already has, to make sure that bans from games are not bypassed. This e.g. can include comparing data of multiple accounts created under the same name.

b. Recipients

Recipients of the processed personal data are the respective internal employees and freelancers of ours that are responsible for pursuing our purposes for the processing. The following categories of recipients can receive data:

  • Hosting providers
  • Analytics and business intelligence services
  • Cyber security services

c. Purpose

The processing of your data is based on our legitimate interest to prevent fraudulent or illegal behavior, especially to make sure that bans are not bypassed and the integrity of the game and esports are not damaged by repeated cheating (e.g. by creating multiple accounts).

d. Legal Basis

The legal basis for the processing of the data based on our legitimate interest stated above is Art. 6 para. 1 let. f) GDPR.

e. Storage Period

The data is stored for as long as our legitimate interests are given. This especially is determined by the fact if you received a ban or not and what kind of ban you received (e.g. for cheating in a game or violating rules regarding the use of our website). Please view our section regarding the Badlion Client / Anti-Cheat functionality in this Privacy Policy for further details on how we process personal data in connection with bans for cheating.

If you have violated our terms and conditions for using our services, we store the relevant personal data to identify you for 4 years. We chose this storage period based on the statute of limitations of 4 years for actions made upon a contract stated in § 337 of the California Code of Civil Procedure (CCP).

If the data is also processed for another purpose set out in this Privacy Policy, the storage period regarding that purpose applies as well.

7. Community Tools

a. Process

From time to time, EGO may make message boards, chat rooms, forums, news groups and other community tools available to you on EGO Sites. Please keep in mind that whenever you voluntarily disclose personal information in these public areas, your information can be viewed and used by EGO (e.g. quoted or analyzed for feedback) and also used by the users of such tools.

b. Recipients

Recipients of the processed personal data are the respective internal employees and freelancers of ours that are responsible for pursuing our purposes for the processing. The following categories of recipients can receive data:

  • Hosting providers
  • Analytics and business intelligence services
  • Cyber security services

c. Purpose

The data is processed to provide you the functionality of our community tools. Thus, the processing is based on our legitimate interest to provide our users with functional and user-friendly ways to communicate. Depending on the respective tool, it is also possible that it is provided to you by us to perform a contract you have concluded with us. In such a case it is possible that we could not provide the tool effectively without processing the data.

d. Legal Basis

The legal basis for the processing of the data based on our legitimate interest stated above is Art. 6 para. 1 let. f) GDPR. Should the tool be provided to you for performance of a contract with you, the legal basis is Art. 6 para. 1 let. b) GDPR.

e. Storage Period

The data is stored for as long as our legitimate interests are given. This especially is determined by the status of your user account. Your data will be stored for as long as your account with us exists.

If the data is also processed for another purpose set out in this Privacy Policy, the storage period regarding that purpose applies as well.

8. Social Media Presences

a. Process

EGO maintains online presences within social networks and platforms in order to communicate with customers and users active there, and to inform them about EGO services. When calling the respective networks and platforms, the terms and conditions and the data processing guidelines apply to their respective operators.

Apart from data processed by these third parties, we process personal data you publish on the social networks and platforms when this relates to us or our online presences, e.g. when you comment posts on our online presence or refer to us with a hashtag we process your user name and the content of your comment.

b. Recipients

Apart from the respective social network or platform, the recipients of the processed personal data on our side are the respective internal employees and freelancers of ours that are responsible for pursuing our purposes for the processing.

c. Purpose

The data is processed to stay in touch with you and other interested audiences through the global channels of social media and other platforms. Thus, the processing is based on our legitimate interest to communicate in an effective way with a global audience regarding our services and products.

d. Legal Basis

The legal basis for the processing of the data based on our legitimate interest stated above is Art. 6 para. 1 let. f) GDPR.

e. Storage Period

The data is stored by us for as long as our legitimate interests are given. This especially is determined by if you communicate with EGO within social networks and platforms, e.g. write posts on EGO’s online presence or send messages. If you send us non-public messages over social media channels our legitimate interest and the storage period depends on the specific circumstances of our conversation (e.g. the importance of the topic of our conversation to us). Posts and other publicly accessible communication will be deleted when we delete our account. Please note that we have no influence on how the respective social network processes your data. Regarding this, please read the social network’s privacy policy.

If the data is also processed for another purpose set out in this Privacy Policy, the storage period regarding that purpose applies as well.

9. Registration for Competitions and Events

a. Process

When you register for competitions and events of ours, we process your account and profile data of the respective account which you use for signing to a competition or event (e.g. Badlion, ESL ID or ESEA account details (username, email address, etc), profile information (teams, game experience, etc)).

b. Recipients

Recipients of the processed personal data are the respective internal employees and freelancers of ours that are responsible for pursuing our purposes for the processing. The following processors process the personal data on our behalf:

  • Hosting providers
  • Analytics and business intelligence services
  • Cyber security services
  • Payment providers (e.g. Xsolla, PayPal, Steam, Stripe, Matcherino, etc)

c. Purpose

We process your personal data to be able to enter into a contract with you regarding your participation, to identify you as an authorized participant and to perform other contractual obligations we may have with you regarding your participation, especially enabling your participation in the competition and paying out your prize money, should you have a claim for such according to the respective rules of the competition.

d. Legal Basis

The legal basis for processing your data is Art. 6 para. 1 let. b) GDPR.

e. Storage Period

The data is stored for a period of 3 years after the event has ended.

10. User surveys and polls

a. Process

We process your account details and profile information when we conduct surveys and polls.

b. Recipients

Recipients of the processed personal data are the respective internal employees and contractors of ours that are responsible for pursuing our purposes for the processing. The following processors process the personal data on our behalf:

  • Hosting providers
  • Analytics and business intelligence services
  • Cyber security services
  • Internal marketing personnel of the ESL Group

c. Purpose

The data is processed to understand better what you like about our services and products and how we can improve these to grant you a better experience with them.

d. Legal Basis

The legal basis for processing data you provide in surveys and polls is your consent according to Art. 6 para. 1 let. a) GDPR.

e. Storage Period

Your data is stored for as long as you do not withdraw your consent. You can at any time withdraw your consent by sending us an email to [email protected] Please note that the withdrawal does not affect the lawfulness of the processing done prior to your withdrawal. If the data is also processed for another purpose set out in this Privacy Policy, the storage period regarding that purpose applies as well.

11. Participation in Sweepstakes, Contests or Promotions Sponsored by EGO or Third Parties

a. Process

If you participate in sweepstakes, contests or promotions sponsored by EGO or third parties we process the data that is required for your participation.

b. Recipients

Recipients of the processed personal data are the respective internal employees and contractors of ours that are responsible for pursuing our purposes for the processing. The following processors process the personal data on our behalf:

  • Hosting providers
  • Analytics and business intelligence services
  • Cyber security services
  • Payment providers

If the event you are participating in is co-conducted by a partner of ours, we may share specific information of yours with the partner if this is necessary to properly conduct the event (e.g. we will share your name and address with a partner if the partner grants you a prize).

c. Purpose

The purpose of processing your personal data or, if necessary, sharing your personal data related to the sweepstake, contest or promotion with our partner, is making sure that you can participate properly in such an event. This may involve concluding or performing a contract with you. If you do not conclude a contract with us when participating, but instead with our partner, we have a legitimate interest in receiving specific personal data of yours related to the event from our partner if this is necessary for properly conducting the event.

d. Legal Basis

If you conclude a contract with us regarding the event, the legal basis for processing and, if necessary, sharing your personal data with our partner is Art. 6 para. 1 let. b) GDPR. If the processing is based on our legitimate interest, the legal basis is Art. 6 para. 1 let. f) GDPR.

e. Storage Period

The data is stored for a period of 3 years after the event has ended.

12. Purchasing Products and Services

a. Process

When you purchase products and services of ours (e.g. over our website), we process your account details and profile information.

b. Recipients

Recipients of the processed personal data are the respective internal employees and contractors of ours that are responsible for pursuing our purposes for the processing. The following processors process the personal data on our behalf:

  • Hosting providers
  • Analytics and business intelligence services
  • Cyber security services
  • Payment providers

c. Purpose

The purpose for processing your data is concluding and performing a contract with you regarding the service or product you purchased.

d. Legal Basis

The legal basis for processing your data is Art. 6 para. 1 let. b) GDPR.

e. Storage Period

The data is stored for a period of five years after the event has ended.

13. Integrated Services and Content of Third Parties

Based on EGO’s legitimate interest to analyze, optimize and economically operate our online offer and the corresponding legal basis of Art. 6 para 1 let. f) GDPR, EGO makes use of content or services offered by third-party providers in order to provide their content and services, such as including videos (hereinafter collectively referred to as "Content").

This always presupposes that the third-party providers of this Content perceive the IP address of the users, since they could not send the Content to their browser without the IP address.
