I noticed that all the people with ranks are on the Badlion side with donations, as in they need the money for the server.But the non-donors can't play and it IS somewhat pay to play, I thought there was EULA if I'm not mistaken!

The EULA forbids pay to win gamemodes, but doesn't forbid pay to play. It's a business model used by a number of servers.
