When there are only two people left their kits should be refreshed. The reason this should happen is because you could be fighting the 3rd person for quite a while then in comes the only other guy in the arena and he just takes a few swings and takes your kill, now you are out of pots and have absolutely no chance of having a fair fight against the guy who stole your kill.
