It does and doesn't at the same time. Mojang is allowing servers to charge for access as long as all players pay the same price.

Even though they are giving the same features to all players, there are multiple "tickets" here (one for 1 month, one for 6 months etc.). Therefore they are technically breaking the EULA, but it's in such a way that I can't imagine Mojang terminating their "Premium" service for it.
